APARTMENT REGISTRATION now OPEN Now the govt. has published the Gazette regarding registration of the Common Areas. People can start sale/resale of their apartment subject to fulfilling the conditions mentioned in the linked X post. Congratulations to all Association of Allottees, who will now get the Ownership rights over the Land. Section 17 of RERA can now be implemented.

APARTMENT REGISTRATION IN ODISHA: Do NOT rush to the Sub-Registrar! While we wait for the Governor’s assent to the Ordinance on stamp duty for registration of Common Areas in apartments, please note the following: IMPORTANT:The Sub-Registrar will register a sale deed ONLY if it is properly endorsed by the concerned Competent Authority. Thus, the sale deed needs to be presented before the Competent Authority first. CORRECT PROCEDURE ⬇️ Register the Association of Allottees 🔽 Obtain the Occupancy Certificate (OC) 🔽 Builder submits the Declaration 🔽 Register the Common Areas (including the entire land) in the name of the registered Association (The proposed amendment to the Stamp Act will clear the current bottlenecks, but all the above steps still need to be completed.) 🔽 Present the Sale Deed to the Competent Authority 🔽 Competent Authority verifies all documents and endorses the Sale Deed 🔽 Take the endorsed Sale Deed to the Sub-Registrar for payment of stamp duty & registration fees and final registration. ASSOCIATION (Form-A)➡️ OCCUPANCY CERTIFICATE➡️DECLARATION (Form-D)➡️ COMMON AREAS REGISTRATION (Form- G)➡️ ENDORSEMENT ➡️SALE DEED (Form-F) ✅BEFORE YOU GO TO THE SUB-REGISTRAR, ENSURE YOUR PROJECT HAS: (i) Valid Occupancy Certificate (ii) Association of Allottees already registered (iii) Entire project land registered in the name of the Association (iv) Sale Deed endorsed by the Competent Authority ✅EXCEPTIONS/SPECIFIC SITUATIONS 1. Resale of apartments registered before 05.10.2016: Registration is still open as before. No new hurdles. (ONLY FOR RESALE) 2. Old projects in which the land owner wants to sell now: Must follow the full procedure mentioned above. Note: though there are reports regarding Sub-Registrars illegally allowing registrations in violation of the law without following the provisions of law. @IGROdisha #DSRBBSR 3. Projects where some flats are already registered and some are pending: (For already registered flats, their proportionate land share is deemed transferred to the Association. However, Common Areas for the remaining flats are not yet transferred): You must follow the full procedure. Register the remaining land in the name of the Association first. Only then can registration of the remaining flats resume. 4. Projects in which all Apartments have been registered: No need of any new registration of the common areas/land, as it is already deemed transferred to the Association. CONSUMER PROTECTION in ICU #Odisha‼️(the state commission lost the file but recovers after High Court's notice) HOW SERIOUS the Govt. @CMO_Odisha is to protect consumers in the state⁉️ timesofindia.indiatimes.com/city/bhubanesw… To prevent a total stalemate, the Odisha government recently extended the terms of State Commission members, including Dr. Pramode Kumar Prusty and Sri Hemant Kumar Mohanty, until current recruitment cycles conclude. The larger question is, has the recruitment cycle started in Odisha? If not why❓ ➡️2020: the new rules came in the country ➡️2021: Supreme Court directed all states to fill vacancies ➡️2025: Odisha High Court asked to fill up posts within 6 months ➡️2026: Odisha High Court remarks on the functioning of the state consumer Commission, 1️⃣this court seriously deprecates the practice adopted by the state Consumer Dispute Redressal Commission, Odisha, 2️⃣the conduct of the state Consumer Dispute Redressal Commission, Odisha reveals lack of seriousness and casual approach. 3️⃣they ought to be more careful in future, 4️⃣appeal was disposed of in the absence of parties, 5️⃣after reserving the order, the matter was kept pending for one and half years ➡️5.3.2026: Two of the members who were deprecated were given extension by @Food_Odisha Reward for disposing only 13 cases in 3 years or the reason is something deeper❓ Attached: TOI news, Odisha HC order, letter of extension of members.

"WE LOST the FILE": The Odisha State Consumer dispute redressal commission, justifying a delay of more than 1.5 years regarding reserving for judgement after conclusion of hearing on 19.07.2024. THE CASE (A case of insurance claim after the death of a 37 years old husband during Covid) 01.07.2021: Death of the Husband ⬇️ The insurance company @HDFCLIFE repudiated the life insurance claim. Even refused to give a copy of the proposal form to the wife. ⬇️ District Consumer Commission, Cuttack vide C.C. No.16 of 2023 allowed the complaint case in favor of the wife vide judgment dt.29.09.2023. ⬇️ The insurance company challenged the said judgment in appeal before the state commission vide F.A. No.635/2023 ⬇️ The Bench -II of Member P.K. Prusty and Member Hemanta Kumar Mohanty at the State Consumer dispute redressal commission heard the matter and reserved for judgment on 19.07.2024. ⬇️ After prolonged delay in getting the order, the wife filed WP(C)20547/2025 in the High Court. After understanding the state of affairs of all the district forums as well as state commission, In its order dt.20.08.2025, the Honorable High Court directed, "The State Government is, therefore, directed to take necessary steps for filling up of the vacant sanctioned posts across several district forums/State Commission within the State and it is desirable that the entire process should be completed within six months from date." ⬇️ In the meanwhile, RTI reply of the state commission dt 12.01.2026, Question(1): No. of Judgments on merit delivered by the Bench comprising of Hon'ble Member, Mr. P.K.Prusty and Hon'ble Member, Mr. Hemant Kumar Mohanty from 01.01.2023 till 8.12.2025. Reply: Total No. of Judgments on merit-13(Thirteen) Question(2): Original Complaint case and First Appeal Cases pending in the State Commission since from which year? Reply: Original Complaint case pending in the State Commission since 2000 and First Appeal Cases pending in the State Commission since 2003.(As per E-Jagriti Portal) ⬇️ After the failure of the state commission to pass the order, the petitioner filed another case WP(C) 3106/2026. The Odisha High Court on 04.02.2026 directed, "Learned counsel appearing for the Opposite Party No.3 also did not dispute the fact that the judgment has been reserved for more than 2 years ago. In the aforesaid factual backdrop, the Secretary of the Odisha State Consumer Dispute Redressal Commission, Cuttack is directed to submit a report with regard to the status of FA No.635 of 2023 by the next date" ⬇️ The commission after receiving the notice from the High Court came out of deep sleep and disposed of the case on 13.02.2026, stating, "The appeal was heard and owing to misplacement of file, administrative constraints, particularly the non-availability of stenographic assistance, the order has since been finalized and is being pronounced after completion of necessary formalities." (1) they misplaced the case file, (2) no attempts were made to find the file, (3) no accountability was fixed for loss of file, (4) But, the file was found within days after the show cause notice from the High Court reached them, (5) they also had some "administrative constraints" to give the order, (6) also, Stenographers are not available at the Commission. The above observation of the state commission suggests that the state government has not done enough to fill up the posts, even after the Honorable High Court's direction in that regards. Even then, how can the members of Bench-II at the commission justify disposing only 13 cases in 3 years? @mohitagarwal86 The 3 Dec 2025 notification allowed resale of flats registered before 5 Oct 2016. What about those registered after this cut off date, having no OC, registered Association and other documents mandated by Rera ? Will the Government regularise these apartments?

The Supreme Court sent notices to @OdishaRera & @HUDDeptOdisha regarding the poor execution rate of ORERA orders as well as sending orders to the Civil Court for execution. The Apax Court also attached all movable & immovable properties of a builder Vipul Limited in #Bhubaneswar
