@NeilMcCauley226 @CynicalPublius I’m not, and I would never claim to be an infantry officer. Your statement about JAGs not being officers chosen by the pres doesn’t add up. JAGs are officers, and in the Marine Corps, we have the same initial 8+ months training as any officer, be it LogO, Pilot, or Infantry

Having served two full and entirely separate careers (one as a basic branch Army officer, and one as a civilian attorney), I can assure everyone that--just like lawyers in real life--JAGs are rent seekers that do virtually nothing to enhance the mission and instead serve to dramatically degrade mission effectiveness and readiness. The role of JAGs in tactical operations needs to be scaled back dramatically, post-haste. They still have a role, however, as Trial Defense for the E-2 who tried to sell a bag of oregano as weed. But that's about it.

We are not taught that at all Naval Justice School, where Marines, Coasties, and Navy JAGs all go for training. Your job 99 times out 100 is to find a path to yes for a commander

The **U.S. Supreme Court** is the court that can ultimately overrule or reverse a decision under the Uniform Code of Military Justice (UCMJ). UCMJ decisions originate from courts-martial (trial-level military courts). Appeals follow this hierarchy: - First level: One of the service-specific **Courts of Criminal Appeals** (e.g., Army Court of Criminal Appeals, Air Force Court of Criminal Appeals, Navy-Marine Corps Court of Criminal Appeals, or Coast Guard Court of Criminal Appeals). These review both factual and legal issues and can overturn convictions, reduce sentences, or order new trials in many cases. - Next level: The **U.S. Court of Appeals for the Armed Forces** (CAAF), an Article I federal appellate court. It reviews decisions from the Courts of Criminal Appeals, but only on matters of law (not facts or sentence appropriateness unless tied to legal error). The CAAF is the highest court within the military justice system. - Final potential review: The **U.S. Supreme Court**. Under 28 U.S.C. § 1259, it has discretionary jurisdiction (via writ of certiorari) to review CAAF decisions, but only if the CAAF has granted review or otherwise acted on the case. If the CAAF denies review, the Supreme Court generally lacks direct jurisdiction over that military case. Supreme Court review of UCMJ cases is rare. No other civilian federal or state court can directly overrule a UCMJ decision in the standard appellate sense (though collateral challenges, like habeas corpus petitions in federal district courts, are possible but limited in scope and rarely succeed in overturning the core military judgment). The Supreme Court remains the only civilian court with potential authority to reverse or vacate a final UCMJ ruling after exhaustion of military appeals.

No one is asking any generals to pass political loyalty tests. They are, however, being asked to pass political DISLOYALTY tests. We cannot have serving flag officers who are openly disloyal to the lawful orders of POTUS and SecWar. @sammysturger @CurrentRevolt In what world is it sufficient to say “litigation will cost $75,000+ therefore the threshold requirement amount is satisfied?” I think it’s pretty clear that one cannot use attorneys’ fees as a way to cheat cases that are below the $75k threshold into Fed Court.
