Prof Welshman Ncube demands Biti’s immediate release Professor Welshman Ncube has condemned the arrest of opposition leader, Tendai Biti yesterday as a clear selective application of the law and demanded his immediate release. Biti who is the Constitutional Defenders Forum (CDF) convener was arrested together with journalist Fanuel Chinowaita, Hon Morgan Ncube and Nyasha Gerald in Mutare when they were conducting a peaceful meet the people campaign, opposing Constitutional Amendment Bill Number 3. Ncube also demanded an end to selective application of the law and the restoration of a free and open democratic space where all citizens participate without fear. In a statement released today, Ncube who leads a CCC faction said the arrest is a blatant assault on Constitutional freedoms, particularly the rights of freedom of expression, association and political participation. “Zimbabwe belongs to all citizens- not to a single party or political elite. The amendment 3 is not good news for the nation. However, on a more positive note, it presents an opportunity for Zimbabweans in the opposition to distinguish the men from the boys, to separate noise from substance, and to tell apart mere eloquence from genuine insight. It may also help to confirm whether those who have been labelled as sell-outs have, in fact, not sold out anything to ZANU-PF. Let me illustrate by way of a simple example that is readily comprehensible. Should the Minister of Education decide to extend the duration of a school term by a few weeks, does it follow that when learners resume for the ensuing term, they will be in the third term? The answer is in the negative, they shall remain in the second term. The extension of a term does not constitute the creation of an additional term, and such an action does not necessitate a referendum. Our Constitution expressly identifies three matters in respect of which any amendment requires a referendum: 1.Chapter 4, which pertains to the Bill of Rights 2.Chapter 16, which pertains to agricultural land 3. section 328, which pertains to the extension of a term of office. It is an undisputed fact that the present amendment does not engage any of the said matters that would trigger a referendum requirement.

So many people have heard lies about the story behind this picture. The correct story is that Kevin Carter (a South African) took this photo in 1993 in Ayod, Sudan, during famine. The child (a boy named Kong Nyong, not a girl) was moving towards a UN feeding center. Carter stopped and took a picture of the event. He later chased the vulture away after shooting, and took the boy to the center. The boy survived to reach aid and lived until his death in 2007 from illness. Carter won the 1994 Pulitzer but died by suicide 4 months later, haunted by traumas from wars and poverty he covered (plus personal struggles like debt and depression). There are no interviews of him claiming to have left the child.
