There is this little pesky rule in place that all DOJ employees must adhere to. "If any employee has any contact with any Law Enforcement officials, it must be reported to your supervisor, immediately." On January 29, 2022, Brian Higgins was employed by the ATF which falls under the umbrella of the DOJ. All his contacts with anyone in Law Enforcement surrounding the murder Officer John O'Keefe had to be reported to his immediate supervisor. Now that it has been confirmed that Higgins provided a Federal Proffer to FBI Agents and ASUAs assigned to the Federal investigation into the murder of O'Keefe, that too had to reported to his supervisor, if in fact, he was still employed by the ATF at the time. Lets remember why people provide proffers to the Feds: "A proffer agreement (also known as the proffer letter) is a written contract between a person who is under a criminal investigation and a federal prosecutor. It is not a promise of absolute immunity or a plea agreement, but an agreement between the defendant and the government for a certain level of “use immunity.” A proffer agreement is often a door to making someone a cooperating defendant who may be eligible for a favorable, less severe sentencing recommendation." There is NO DOUBT the FEDS used Higgins against Brian Albert. Higgins' attorney knew that the Feds were gaining leverage and all roads were leading to the weakest link. That was Higgins. There would be no other reason why Higgins would provide the Feds a Proffer prior to testifying before the federal Grand Jury. Higgins provided investigators key evidence that allowed them to pursue other leads. The question that still remains, why didn't the Feds provide Higgins a "Cooperation/Plea Deal agreement?" Did Higgins hold back? Did he minimize his role in the conspiracy? Or, did the Feds offer him a deal that Higgins refused or could NOT accept. There is a reason why his attorney, a former AUSA, was in close proximity during the testimony that Higgins provided at the trial against Karen Read.
