৩/৩ ৭. ‘হবিগঞ্জে মুক্তিযুদ্ধ’ শিরোনামে বইতেও একই বার্তার ছবি পাওয়া যায়। ছবিটি ভালোভাবে পর্যবেক্ষণ করলে দেখা যায় সেটি আসলে “PAKISTAN POSTS AND TELEGRAPHS DEPARTMENT”-এর প্যাডে লিখিত বঙ্গবন্ধুর বার্তা। যদিও ছবিটির বাম দিকে “PAKISTAN POS” অংশটুকু কাটা রয়েছে তথাপি সেটা যে “PAKISTAN POSTS AND TELEGRAPHS DEPARTMENT”-এর প্যাড সেটি বুঝতে অসুবিধা হয় না। এই মেসেজটি এবং পাবনা শাহজাদপুরের ওসি আবদুল হামিদ যে টেলিগ্রাফিক বার্তাটি পেয়েছিলেন এই দুইটির ট্রান্সক্রিপ্ট হুবহু এক, কিন্তু হাতের লেখা ভিন্ন। দুটি বার্তাই “PAKISTAN POSTS AND TELEGRAPHS DEPARTMENT”-এর প্যাডে লিখিত। কয়েকদিন আগে সোশ্যাল নেটওয়ার্কে একজন একটি বার্তার ইমেজ দিয়ে দাবি করেন যে, সেটি বঙ্গবন্ধুর স্বহস্তে লিখিত এবং স্বাক্ষরকৃত। কিন্তু সেই ইমেজটি এবং হবিগঞ্জে প্রাপ্ত টেলিগ্রাফের ইমেজ হবহু এক। শুধুমাত্র উপরে “PAKISTAN POSTS AND TELEGRAPHS DEPARTMENT” অংশটা কেটে দেওয়া হয়েছে। ফলে ‘বঙ্গবন্ধুর স্বহস্তে লিখিত এবং স্বাক্ষরকৃত’ এই দাবির পক্ষে শক্ত কোনো প্রমাণ আমরা এখনও পাইনি। উল্লেখ্য ‘স্বাধীনতা ঘোষণা’ ব্যাপারে সুপ্রিম কোর্টে (রিট ২৫৭৭/২০০৯) যে মামলা চলেছিল সেখানেও কেউ বঙ্গবন্ধুর স্বহস্তে লিখিত এবং স্বাক্ষরকৃত কোনো দলিল দাখিল করতে পারেননি। বঙ্গবন্ধু ২৬ মার্চ প্রথম প্রহরে গ্রেপ্তার হওয়ার পূর্বেই ‘স্বাধীনতা ঘোষণা’-এর বার্তা যে কয়েকজনকে দিয়ে গিয়েছিলেন সারা দেশ ও পৃথিবীময় প্রচারের জন্য, সেটা নিঃসন্দেহে প্রমাণিত। কিন্তু তাঁর ‘স্বহস্তে লিখিত এবং স্বাক্ষরকৃত’ কোনো ডকুমেন্ট বা দলিলের অস্তিত্ত্ব আমরা পাইনি। আমরা বিশ্বাস করি, বঙ্গবন্ধু সচেতনভাবেই স্বহস্তে লিখিত এবং স্বাক্ষরকৃত কোনো দলিল বা ডকুমেন্ট রাখেননি। আজীবন নিয়মতান্ত্রিক আন্দোলন ও সংগ্রামে বিশ্বাসী শেখ মুজিবের পূর্বাপর ঘটনা বিশ্লেষণ করলে কোনো ডকুমেন্ট না রাখাটাই তাঁর বৈশিষ্ট্যের সঙ্গে মিলে যায়। ঠিক যে কারণে ৭ মার্চ তিনি সরাসরি স্বাধীনতা ঘোষণা দেননি (আবার স্বাধীনতা ঘোষণার বাকিও রাখেননি), ঠিক একই কারণে ২৬ মার্চ প্রথম প্রহরে তিনি তাঁর নিজ হাতের লেখা ও স্বাক্ষরকৃত কোনো দলিল/ডকুমেন্ট রাখেননি। বঙ্গবন্ধু আগে থেকেই সিদ্ধান্ত নিয়েছিলেন যে, তিনি কোনো পরিস্থিতিতেই আত্মগোপন করবেন না। এ জন্যই তিনি সবাইকে নিরাপদ স্থানে সরে যেতে বলেছিলেন এবং নিজে হায়েনা পাকিস্তানিদের জন্য অপেক্ষা করছিলেন। এই যে নিজের স্বকণ্ঠে বা স্বহস্তে কোনো দলিল/ডকুমেন্ট না রাখা এবং নিজের বাসভবন থেকে কোথাও না যাওয়া– এ দুটি সিদ্ধান্ত একে অপরের পরিপূরক বলে মনে হয়। কেননা এ ধরনের দলিল আমাদের জন্য আরও আত্মঘাতী হতে পারত। আন্তর্জাতিকভাবে আমাদের স্বাধীনতার যুদ্ধকে বিচ্ছিন্নতাবাদী যুদ্ধ আখ্যা দিয়ে আমাদের স্বাধীনতার আকাঙ্ক্ষা আরও সুদূর পরাহত করা হত। ফলে পাকিস্তানি সেনাবাহিনী যখন বঙ্গবন্ধুকে গ্রেপ্তার করে তখন তারা কোনো বিচ্ছিন্নবাদী নেতাকে গ্রেপ্তার করেনি, বরং একটি দেশের সদ্যনির্বাচিত সরকার প্রধানকে গ্রেপ্তার করে। সৌজন্যেঃ বিডি নিউজ মূল লেখা - বঙ্গবন্ধুর স্বাধীনতা ঘোষণার টেলিগ্রাফিক বার্তা তথ্য সহায়তাঃ মাহবুবুর রহমান জালালইন্টারনেট ও বিভিন্ন বইপত্র। #২৫মার্চকালরাত #মুক্তিযুদ্ধ #মার্চ১৯৭১ #স্বাধীনতাঘোষণা #DeclarationOfIndependence

২৬ মার্চের প্রথম প্রহরে গ্রেপ্তারের আগে বঙ্গবন্ধু বিভিন্ন স্থানে টেলিগ্রাফ বার্তা পাঠিয়ে স্বাধীনতার আনুষ্ঠানিক ঘোষণা করেন বাংলার গণমানুষের হৃদয়ের নেতা শেখ মুজিবুর রহমান সেই ’৭১-এর উত্তাল দিনগুলোতে অসম্ভব রাজনৈতিক মুনশিয়ানার সঙ্গে ধাপে ধাপে পা ফেলছিলেন। তিনি যে ধৈর্য্য ও প্রজ্ঞার সম্মিলন দেখিয়েছিলেন সেটা ছিল অভুতপূর্ব। তারই ধারাবাহিকতায় ৭ মার্চের ঐতিহাসিক ভাষণ এবং পরবর্তীতে ২৫ মার্চ রাতে ২৬ মার্চের প্রথম প্রহরে পাকিস্তানি মিলিটারি তাঁকে গ্রেপ্তার করে। গ্রেপ্তারের আগে তিনি বিভিন্ন স্থানে টেলিগ্রাফ বার্তা পাঠিয়ে স্বাধীনতার আনুষ্ঠানিক ঘোষণা দিয়ে যান। আমরা বিভিন্ন মাধ্যম থেকে স্বাধীনতা ঘোষণার টেলিগ্রাফ বার্তাটির কয়েকটি প্রতিলিপি পেয়েছি– ১. ১৯৭২ সালের ১৮ জানুয়ারি সিডনি এইচ শ্যনবার্গকে দেওয়া একটি সাক্ষাৎকারে বঙ্গবন্ধু বলছেন: “১৯৭১ সালের ২৫ মার্চ তারিখ রাত সাড়ে দশটার দিকে তিনি চট্টগ্রামে একটি গুপ্ত হেডকোয়ার্টারে ফোন করে স্বাধীনতার বার্তা পাঠিয়েছিলেন যেটা পরবর্তীতে গোপন ট্রান্সমিটার দ্বারা প্রচারিত হয়েছিল।” এ ছাড়া ওই রিপোর্টে বলা হচ্ছে, রাত ১২টা থেকে একটার মধ্যে পশ্চিম পাকিস্তানি সৈন্যরা তাঁর বাড়ির উপর গুলিবর্ষণ শুরু করে। তিনি ড্রেসিং রুম থেকে বাইরে বের হয়ে আসেন এবং তাদের মুখোমুখি দাঁড়ান। পাকিস্তানি সৈন্যদের গুলি বন্ধ করতে বলেন এবং জিজ্ঞাসা করেন, কেন তারা গুলি করছে? যদি তারা তাঁকে গুলি করতে চায় সেটা করুক; কেন তারা অন্য মানুষ এবং বাচ্চাদের উপর গুলি করছে? একজন মেজর পেছন থেকে গর্জন করে ওঠে গুলি বন্ধ করতে বলেন এবং তিনি বঙ্গবন্ধুকে জানান, তাঁকে গ্রেপ্তার করা হচ্ছে। আমরা জানার চেষ্টা করছিলাম ঠিক কয়টার সময় বঙ্গবন্ধুকে গ্রেপ্তার করা হয়। বঙ্গবন্ধুকে গ্রেপ্তার করতে আসা একজন অফিসার ছিলেন ব্রিগেডিয়ার জেড এ খান। তার লিখিত ‘The Way It Was’ বইয়ে গ্রেপ্তারের সময় উল্লেখ নেই। দৈনিক বাংলা, ৮ম বর্ষ, ১২৯শ সংখ্যা, রোববার, ১২ই চৈত্র ১৩৭৮, ২৬ মার্চ ১৯৭২ তারিখে বেগম মুজিবের সাক্ষাৎকার প্রকাশিত হয়। সেখানে বেগম মুজিব বলছেন: “রাত প্রায় সাড়ে ১২টার দিকে ওরা গুলি ছুড়তে ছুড়তে উপরে উঠে এল।” এরপর আমরা পাকিস্তানি ‘Dawn’ পত্রিকার ২৮ মার্চ, ১৯৭১ রবিবার সংখ্যাটি হাতে পাই। সেদিন “Army in full control in East Pakistan, Skeikh Mujib arrested from his house” শিরোনামে “A Government handout in Karachi”-এর বরাত দিয়ে বলা হচ্ছে রাত ১.৩০টার সময় বঙ্গবন্ধুকে গ্রেপ্তার করা হয়েছিল। এ ছাড়া এই ঘৃণ্য ঘটনার একজন মূল পরিকল্পনাকারী রাও ফরমান আলী তার ‘How Pakistan Got Divided’ নামক বইতেও শেখ মুজিবকে রাত ১.৩০টার সময় গ্রেপ্তারের কথা উল্লেখ করেছেন। ২. ইপিআরের শহীদ সুবেদার মেজর শওকত আলীর কন্যা ও রাজশাহী বিশ্ববিদ্যালয়ের প্রফেসর সেলিনা পারভিনের সাক্ষাৎকারে পাওয়া যায়– ২৫ মার্চ ১৯৭১ তারিখ রাতে সুবেদার মেজর শওকত আলী পিলখানাতে অবস্থান করছিলেন। তাঁর পরিবার রাজশাহীতে অবস্থান করছিলেন। তিনি ছিলেন সিগন্যাল কোরে বাঙালিদের মধ্যে সিনিয়র। আজিমপুর গেইটে প্রহরারত সৈনিকের মারফত রাত ১০টার কিছু পরে তাঁর কাছে মেসেজ পৌঁছে যায়। তাঁর সঙ্গে সে রাতে আরও দু-একজন ছিলেন। রাত সোয়া ১২টা বা তার কাছাকাছি কিছু সময় পরেই অয়্যারলেস মেসেজ ট্রান্সমিটাররত অবস্থায় তিনি পাকিস্তানি বাহিনীর হাতে ধরা পড়েন। প্রফেসর সেলিনা পারভিনের ভাষ্যে: “সেই রাতে বঙ্গবন্ধুর স্বাধীনতার ঘোষণা সুবেদার মেজর শওকত আলী যখন ট্রান্সমিট করছিলেন তখন তাঁর সঙ্গে ছিলেন সিগন্যালম্যান আব্দুল মোত্তালিব। আব্দুল মোত্তালিব সেই বিরল সৌভাগ্যবানদের একজন, যিনি সেই রাতে জনাব শওকত আলীর সঙ্গে গ্রেপ্তার হয়েও বেঁচে ফিরে আসতে পেরেছিলেন এবং এখনও জীবিত। তাঁর সাক্ষাৎকার আমি সেদিনই নিয়েছি। স্বাধীনতার ঘোষণা ট্রান্সমিশনে জনাব শওকত আলী ‘মোটোরোলা এসবিসি-৩’ সেট ব্যবহার করেন। এটি ইপিআর সিগন্যাল কোরে ব্ল্যাকসেট বলে জনপ্রিয়। সেটটিতে ভয়েস অপশন ও টিজি অপশন দুটোই রয়েছে। “২৫ র্মাচ রাতে চট্টগ্রামে সিগন্যালম্যান আবুল খায়ের (বর্তমানে সুবেদার মেজর এবং মুক্তিযোদ্ধা হিসেবে দুই বছর অতিরিক্ত চাকরির সময়সীমাপ্রাপ্ত বিধায় চট্টগ্রামে কর্মরত) ওয়ারলেসের সেট নিয়ে ডিউটিতে ছিলেন। ঊর্ধ্বতন কর্মকর্তার নির্দেশে তিনি তাঁর এসবিসি-৩ সেটে ভয়েস অপশন অফ করে রেখেছিলেন। রাত সাড়ে ১১টার কাছাকাছি তিনি তাঁর সেটে টিজি (টেলিগ্রাফিক) অপশনে বঙ্গবন্ধুর স্বাধীনতার ঘোষণাটি পান এবং মেসেজ আনকোড করে তৎকালীন কমান্ডার ক্যাপ্টেন রফিকুল ইসলামকে হস্তান্তর করেন। ক্যাপ্টেন রফিকুল ইসলাম মেসেজ প্রাপ্তিমাত্র তা চট্টগ্রামে সংশ্লিষ্ট সবাইকে প্রেরণের ব্যবস্থা গ্রহণ করেন।” ১/২

Under this practice, a person who is already detained is re-arrested in a new case (often with questionable or fabricated allegations) immediately after being granted bail in an existing one, allowing authorities to keep them incarcerated indefinitely. This mechanism was widely abused under the #Yunus-led Interim Govt to keep AL-affiliated individuals detained for prolonged periods. Following the formation of the new BNP Govt, rather than the practice ending, it appears to have intensified. What does the law say? The governing provision is Section 167A of the Code of Criminal Procedure, which states that if a person already in custody is to be shown arrested in another case, a magistrate should allow this only if the application appears to be “well-founded.” In principle, this means a person should not be shown arrested in a new case unless there is genuine and substantial evidentiary basis linking them to that case. In practice, however, this safeguard appears largely ignored. Magistrates regularly approve such applications with little scrutiny, raising concerns that courts are acting in line with executive diktats rather than independently assessing the merits of the police application. Notable Examples A striking example of the abuse can be witnessed in the case of former Chief Justice ABM Khairul Haque. On 11 March, the High Court granted Justice Haque final bail in the various cases pending against him. However, the process of releasing him was immediately stalled after police filed an application to show him arrested in yet another case, a murder case from July 2024. Notably, Haque was not even named in the original FIR. As Bergman wrote, the allegation “seems wholly fabricated”, i.e. an attempt to prevent his release. A similar pattern emerged in the case of Selina Hayat Ivy, the former Mayor of Narayanganj. Ivy was recently granted bail in five separate cases. Yet shortly afterward, police filed another application seeking to show her arrested in a different case that again appeared plainly fabricated. When the matter came before the magistrate, the crucial legal question should have been whether the police application was “well-founded.” But once again, the court did not appear to independently examine the evidential basis of the claim before approving the application. Yesterday, Bangladesh Watch highlighted the devastating impact of the “shown arrested” practice on detainees and their families through the tragic example of former Chhatra League leader Shafiqul Islam. Shafiq died after being subjected to this malpractice for eight and a half months. His prolonged incarceration, sustained through repeated “shown arrested” applications, illustrates the human toll of a system where legal safeguards are ignored.
