@DHSgov @nytimes There are many legal ways to be in the U.S. even with an expired visa. But you know that already....

@ReichlinMelnick Asylum applicants can still assert asylum as a relief application against deportation with EOIR. So while this is a crappy rule it correct to say they will never get a chance to argue their case. Of course, getting a fair adjudication with EOIR is, er, increasingly unlikely

NEW: The Trump admin just published a new regulation allowing asylum officers at @USCIS to deny hundreds of thousands of applications without an interview, sending applicants directly to deportation proceedings. This means many people will never get a chance to argue their case.

Reminder to Colorado journalists: if you’re interviewing a winning candidate who usually claims that elections are rigged, ask them why this election was rigged in their favor.

I just finished reading Clarence Thomas's dissent.  I encourage you to do the same.  If you take the time to read Roberts's opinion and compare it to Thomas's dissent, Thomas completely outclasses Roberts.  His is a step-by-step history and constitutional lessen that brilliantly and methodically unravels every aspect of Roberts's argument.

@marklevinshow Chief Justice Roberts is a swampy, compromising politician, not a legal scholar. Thomas, in contrast, is a brilliant originalist justice.

On information and belief I think USCIS has disabled the search on their website from finding the asylum application info during the world cup.

BREAKING - Dorcas judge says vacating of USCIS 39 countries benefits pause must take effect NOW. "1. The Challenged Policies as a whole—the Benefits Hold Policy, the Global Asylum Hold Policy, the Comprehensive Re-Review Policy, and the Country-Specific Factors Policy—are contrary to law and arbitrary and capricious in violation of 5 U.S.C. § 706(2)(A), (C). Therefore, the Challenged Policies are vacated and set aside pursuant to 5 U.S.C. § 706(2). 2. Partial final judgment shall enter in favor of Plaintiffs and against the Government on Counts I and II of Plaintiffs’ Complaint (ECF No. 1). 3. Within twenty-four (24) hours, the Government shall file a status report, advising the Court as to what specific steps it has taken to comply with the Court’s Order. 4. The Court retains jurisdiction to enforce this judgment." acrobat.adobe.com/id/urn:aaid:sc…

New EOIR record! I just had an asylum merits hearing set for Monday afternoon….one business day notice! But how does the court know I’m available? Because I already have another client set at the same time with the same judge. What a fucking sham.

🚨 More on DHS newly declared war on SIJ! 🚨 No there is no new report or data, it is the one from last december or something. What is new and unheard of!!! is that DHS general counsel have sent a letter to state court judges asking them to be more vigorous in probing (translation asking them to deny case) before issuing predicate orders and sent this suggested list of how **state judges** should conduct their business . JFC how is this even legal?

What did I tell ya. A day after BIA dropped Matter of N-A-G-C, USCIS gives to Fox News Digital some undisclosed and unreleased *report* allegedly revealing "the extent to which the Special Immigrant Juvenile (SIJ) program is riddled with fraud, and oftentimes exploited by the worst-of-the-worst criminals to gain legal status into the country." x.com/DHSgov/status/…

We ask candidates of all political persuasions about their own words and actions. If that makes them “look bad,” perhaps it’s not the fault of journalists.

Holy shit! Someone posted this RFE in a pending immediate relative Adjustment of Status under yesterday's #AOSmemo: "In order to establish your eligibility for adjustment of status, you must demonstrate that there are positive factors in your case, such that your Form I-485 warrants a favorable exercise of discretion. These positive factors may include, but are not limited to, any of the following: *Family ties within the United States; *Residence of long duration in this country (particularly when residence began at a young age); *Hardship to the applicant or applicant's family if relief is not granted; *Education; *Fluency or proficiency in English; *Service in the U.S. armed forces; *A history of employment; *The existence of business or property ties; *Evidence of value and service to the community (ex: religious organizations, volunteer organizations; etc.); *Paying taxes; *Proof of rehabilitation if a criminal record exists; and *Any other evidence demonstrating that a favorable exercise of discretion is warranted in your case.
