Our Constitution doesn’t allow any police organisation at the Centre as police is a state subject. The CRPF, BSF, SSB, ITBP, CISF, Assam Rifles and Coast Guards have been raised as other armed forces of the Union as per Schedule 2 of the Constitution. See the irony: they changed the name of CPMF into CAPF. This is illegal and unconstitutional. The CAPF General Administration Bill 2026 is an outcome of the high-handedness of the ruling party. Parliament has powers to make legislations but not arbitrary decisions that adversely impact the majority of the citizens and its soldiers. This is a glaring case of strangulation of democracy and subversion of parliament into their personal fiefdom.

Each was created with a defined mandate to serve the people of this country. The present issue is not about inter-service comparison, but about adherence to established service jurisprudence and principles of fairness within the framework of Organized Group ‘A’ Services (OGAS). The CAPFs—such as Central Reserve Police Force, Border Security Force, and others—have been recognized as Organized Group ‘A’ Services. The fundamental attribute of an OGAS is a structured cadre management system ensuring assured career progression through internal promotions, particularly for posts up to the Senior Administrative Grade (SAG), which in these forces corresponds to the level of Inspector General (IG). It is precisely this principle that cadre officers have been consistently asserting. The demand is simple and legitimate: that posts up to SAG level be filled by promotion from within the cadre, as is the norm across other OGAS in the Government of India. This is neither a demand for exclusivity nor an opposition to deputation. Deputation is a well-recognized administrative tool, and we are not against it. However, deputation cannot become a mechanism to structurally deny cadre officers their rightful promotional avenues. The issue has also been examined judicially. The Supreme Court of India, after considering all arguments—including those relating to operational requirements, coordination, and leadership inputs from IPS officers—did not accept the justification for continued deviation from OGAS principles in CAPFs. The spirit of that judgment was to restore parity and uphold cadre rights. It is pertinent to note that the Railway Protection Force, functioning under the Ministry of Railways, has moved towards implementing the judicial directive in letter and spirit. This demonstrates that administrative alignment with the legal position is both feasible and practical. The divergence in approach by the Ministry of Home Affairs, therefore, raises legitimate concerns. What is even more troubling is the recent legislative attempt to accord statutory backing to a structure that effectively bypasses the intent of the judicial pronouncement. If this perception holds true, it risks undermining not only cadre morale but also the sanctity of service rules and the principle of equality across OGAS. The recurring arguments—that IPS officers are inherently more competent, better strategists, or superior in coordination—are neither substantiated nor relevant in a rules-based system. Competence is not the monopoly of any one service, and institutional frameworks cannot be built on subjective assessments. CAPF cadre officers have decades of operational experience, field exposure, and institutional knowledge that are indispensable to these forces. Let us, therefore, not lose sight of the real issue. This is about: •Upholding the defined structure of Organized Group ‘A’ Services •Ensuring fair and predictable career progression for cadre officers •Respecting judicial pronouncements •Maintaining institutional integrity over individual or service-based preferences We are not against any service, nor are we seeking to exclude anyone. Let’s talk logic. If an IPS officer is considered an "outsider" in a security force, then every IAS officer is an outsider in the Ministry of Finance, Science & Technology, or Power. If a Band Gala can lead the Ministry of Science & Technology without being a scientist, why is the Khaki labeled an outsider in a security force? If "years on the ground" were the only criterion for leadership, the oldest sailor would be the Admiral and the longest-serving clerk would be the Cabinet Secretary. Leadership is a specialized skill, not a seniority prize. The IPS is indispensable because it speaks the languages of the MHA, the Judiciary, and the State Police fluently. The government should've talked to these officers before introducing a bill that directly affects their careers and morale. It's weird that the government, which is supposed to protect its people, brought this bill without proper discussion. I still think the government should consider pulling this bill and reintroducing it after talking with stakeholders and legal experts.

The assertion made by Cabinet Minister Sh Kiren Rijuju to PTI news is factually incorrect. It is important to clarify to both PTI and the Indian public that promotions to Additional Director General (ADG) positions for cadre officers were occurring well in advance of 2014 when BJP came to power. Furthermore, the officers within these services are not "local promotees" as suggested by the minister. These officers are cadre officers of their respective services and are integral to an organized Group A service, similar to the 62 other such services within the central government. Comparing a central organized Group A service to state services is inappropriate, as state services operate under their own state-specific regulations rather than central government rules. As per organised group A services rule position all posts upto SAG level in this case upto IG level has to be filled by promotion within the cadre.Instead of elaborating this fact minister is trivalising the issue .As a senior minister, it is imperative to ensure that accurate information is disseminated to the media and the nation.

The quality of debate from certain sections of the treasury benches further raised concerns. In many instances, arguments appeared detached from ground realities, particularly with regard to cadre officers’ service conditions, career progression, and the continued justification of deputation policies without adequate domain experience. Parliamentary debate is meant to ensure rigorous scrutiny and informed decision-making, not mere formal endorsement. At the same time, the role played by the opposition deserves acknowledgment. By presenting structured arguments and bringing forward the concerns of affected personnel, they have upheld the essential democratic principle of checks and balances, which acts as a safeguard against arbitrary decision-making. Parliament is often described as the “temple of democracy,” but its true strength lies in process, participation, and accountability. विषय: सी ए पी एफ कैडर के हितो के विरुद्ध प्रस्तावित सी ए पी एफ जनरल एडमिनिस्ट्रेशन बिल को वापिस लेने हेतु विनम्र निवेदन l माननीय श्री नरेंद्र मोदी जी,प्रधानमंत्री ,भारत सरकार I सादर प्रणाम। मैं आपका ध्यान हाल ही में CAPF (Central Armed Police Forces) से संबंधित लाए गए विधेयक की ओर आकृष्ट करना चाहता हूँ। यह विधेयक जिस प्रकार शीघ्रता एवं सीमित विचार-विमर्श के साथ प्रस्तुत किया गया है, उससे यह गंभीर आशंका उत्पन्न होती है कि कहीं न कहीं आपको इसके समस्त तथ्यों से पूर्णतः अवगत नहीं कराया गया है तथा कुछ भ्रामक या एकपक्षीय जानकारी के आधार पर इसे आगे बढ़ाया गया है। महोदय, यदि इस विषय के सभी पक्ष—विशेषकर CAPF के कैडर अधिकारियों—की बातों को आपके समक्ष समुचित रूप से रखा गया होता, तो मुझे पूर्ण विश्वास है कि आप इस विधेयक को इस रूप में प्रस्तुत करने की सहमति कभी नहीं देते। इस विधेयक में कुछ ऐसे प्रावधान सम्मिलित कर दिए गए हैं, जो सीधे-सीधे कैडर अधिकारियों के हितों पर कुठाराघात करते हैं और उनके मनोबल को प्रभावित करने वाले हैं। जबकि आपके दूरदर्शी नेतृत्व में कुछ वर्ष पूर्व इन बलों को “Organised Service” का दर्जा प्रदान करते हुए उन्हें वित्तीय एवं प्रशासनिक लाभ सुनिश्चित करने की दिशा में महत्वपूर्ण पहल की गई थी। वर्तमान विधेयक उन प्रयासों को निष्प्रभावी करने की आशंका उत्पन्न करता है। मैं आपका ध्यान इस ओर भी दिलाना चाहता हूँ कि इन बलों में नेतृत्व की भूमिका प्रायः आईपीएस अधिकारियों द्वारा निभाई जाती है, जो अल्पकालिक अवधि के लिए प्रतिनियुक्ति पर आते हैं। स्वाभाविक रूप से वे इन बलों की सेवा-शर्तों, प्रशिक्षण आवश्यकताओं तथा जमीनी संचालन की जटिलताओं को उतनी गहराई से नहीं समझ पाते, जितना कि कैडर के अनुभवी अधिकारी समझते हैं। यह भी एक धारणा बन रही है कि कुछ प्रभावशाली तत्व, अपने संस्थागत या व्यक्तिगत हितों के कारण, इन बलों की आवश्यकताओं और कार्यप्रणाली को इस प्रकार प्रस्तुत कर रहे हैं मानो उनकी निरंतर उपस्थिति अनिवार्य हो। यहाँ यह स्पष्ट करना आवश्यक है कि CAPF के अधिकारी और जवान अत्यंत अनुशासित, ईमानदार और राष्ट्र के प्रति समर्पित हैं, जो देश की सुरक्षा और सम्मान के लिए अपने प्राणों की भी परवाह नहीं करते। हाल ही में माननीय सर्वोच्च न्यायालय द्वारा इन बलों के संदर्भ में दिया गया निर्णय पूर्णतः न्यायसंगत एवं संतुलित था, जिस पर आपकी सरकार ने कार्यवाही भी प्रारंभ कर दी थी। ऐसे में अचानक इस प्रकार का विधेयक लाया जाना अनेक शंकाओं को जन्म देता है। महोदय, इस विधेयक के लागू होने से यह सेवा DoPT के क्षेत्राधिकार से बाहर हो सकती है, जिससे इनके “Organised Service” के रूप में प्राप्त अधिकारों एवं संरचनात्मक लाभों पर भी प्रतिकूल प्रभाव पड़ सकता है, क्योंकि DoPT ही ऐसी सेवाओं के लिए आवश्यक नियम एवं शर्तें निर्धारित करता है। महोदय अगर इन बलों का सारा शीर्ष नेतृत्व बाहरी यानि आई पी एस अधिकारियों के हाथों में रहेगा तो कैडर के अनुभवी एवं जिम्मेदार अधिकारी, जिन्हें इन बलों की बारीकियों और संचालन की गहरी समझ है, निर्णय प्रक्रिया में बहुत ही सीमित भूमिका तक ही सीमित रह जायेंगे यह किसी भी दृष्टि से न्यायसंगत नहीं प्रतीत होत है ल आईपीएस अधिकारियों का यह तर्क कि उनकी आवश्यकता संघीय ढांचे के तहत राज्य एवं केंद्र दोनों स्तरों पर होती है को अगर मान भी लें तो यह किसी नियम में नहीं लिखा है और अनिवार्य भी नहीं है कि केंद्र में उनकी नियुक्ति केवल CAPF तक ही सीमित हो। इसके लिए IB, CBI, NIA, ED, NSG तथा अन्य सेंट्रल स्टाफिंग सहित अनेक अवसर उपलब्ध हैं। ऐसे में CAPF पर पूर्णतः उनका आधिपत्य स्थापित होना और कैडर अधिकारियों को दोयम दर्जा की स्थिति में आ जाना न्यायसंगत नहीं है। माननीय प्रधानमंत्री जी, आप एक ईमानदार, न्यायप्रिय और राष्ट्रहित को सर्वोपरि रखने वाले नेता हैं। हम सभी को आपसे अत्यंत आशा और विश्वास है। अतः आपसे करबद्ध निवेदन है कि इस विधेयक को वर्तमान स्वरूप में वापस लेने हेतु आवश्यक दिशा-निर्देश प्रदान करें तथा यदि आवश्यक हो तो सभी हितधारकों के साथ व्यापक विचार-विमर्श कर एक संतुलित एवं न्यायसंगत समाधान के साथ इसे पुनः प्रस्तुत किया जाए। आपके न्यायपूर्ण निर्णय की अपेक्षा में। सादर राकेश कुमार यादव आई जी (सेवा निवृत ) बी-३२,सेंट्रल पार्क-३,फ्लॉवर वैली, सेक्टर-३२-३३,सोहना-गुड़गांव रोड,सोहना (गुड़गाँव) पिन १२२१०३ हरियाणा email id:rakeshbhatotia@gmail.com M No ८५१००००००४ @PMOIndia :::
