I am deeply concerned that the Mohan Majhi government has decided to shut down schools with fewer than 20 students, targeting nearly 5,630 schools across the state, including 1,826 in western Odisha alone. In Sundargarh district, 397 schools are set to close, the highest in the state, followed by 156 in Nuapada. This is a betrayal of our children’s right to education. Instead of improving infrastructure, hiring teachers, and strengthening public education, the BJP government is taking away classrooms from our poorest and most remote villages. The Right to Education (RTE) Act guarantees every child access to free and compulsory education. Closing schools violates this fundamental right. When the government shuts down schools, it shuts down dreams, opportunities, and the future of rural Odisha. @CMO_Odisha

OCCUPANCY CERTIFICATE and POSSESSION No matter what we believe or say regarding non-implementation of rules for "Occupancy Certificate", we home buyers are also at fault. The fact is, We failed to safeguard our own investment, We never thought that the law will ever be implemented, We allowed the builder to cheat us, Now, the "Chalta Hai" approach is proving out to be a costly mistake. Our arguments of "we did not have the knowledge", "why the Authorities did not do their duties", "we trusted the builder", "my property is registered by the sub-registrar and "I have paid the stamp duty".....etc.... have already been considered by the Supreme Court before delivering numerous judgements (extracts from three such orders are quoted below). 1⃣Supreme Court in Civil Appeal No.3343 OF 2020 ".....undoubtedly, they have also been on the wrong side of law by taking possession of their respective flats without the completion certificate, whatever might be the compulsion, we are not inclined to direct the NCDRC to decide on the compensation component." 2⃣Supreme Court Civil Appeal No, 14604 of 2024 "Delay in directing rectification of illegalities, administrative failure, regulatory inefficiency, cost of construction and investment, negligence and laxity on the part of the authorities concerned in performing their obligation(s) under the Act, cannot be used as a shield to defend action taken against the illegal/ unauthorized constructions." 3⃣Supreme Court Special Leave to Appeal (C) Nos.12199-12200/2025 "A person who has no regards for the law cannot be permitted to pray for regularisation after putting up unauthorised construction of two floors. This has something to do with the rule of law. Unauthorised construction has to be demolished. There is no way out." "......each and every construction must be made scrupulously following and strictly adhering to the rules and regulations. In the event of any violation, being brought to the notice of the courts, the same should be dealt with iron hands and any leniency or mercy shown to the person guilty of unauthorised construction would amount to showing misplaced sympathy." Let us not live in denial. We must ask the Government to regularise/bring SOP regarding OC of old projects.......resale registration while the property remains illegal/unauthorised will land the buyer in deeper trouble in future.

BACKGROUND: The Supreme Court on 17.12.2024 directed the @SecyChief to issue circulars related to "Unauthorised Constructions", but. . . . ➡️RTI reply from the GA dept. suggests that even after 8 months of the order, the state has failed to bring out any circular as directed by the court. ➡️After multiple representations went unanswered, a CONTEMPT petition was filed in the Supreme Court. ➡️The Supreme Court while admitting the case, has asked the Chief Secretary, #Odisha to report compliance of the earlier directions/guidelines issued by the court. THE GUIDELINES: On 17th December 2024, the Apex Court directed all states to implement the following guidelines, 1️⃣Builder to give undertaking, "no possession without OC". 2️⃣Builder to display approved plan at the construction site. 3️⃣Completion/Occupancy certificate to be issued by the authorities, that too only after physical verification/inspection. 4️⃣If deviation is found, the CC/OC shall be deferred till rectified. 5️⃣Connections like Electricity, Water, Sewerage shall be given only after OC has been issued. 6️⃣If deviation/Violations are observed after issuance of OC, (i)action against the builder, and (ii)departmental action against the official. 7️⃣No trade licence or permission to conduct business/trade must be given in any unauthorised building. 8️⃣Any development must be in conformity with Zonal plan. 9️⃣Other department must render immediate assistance (when requested for) to the planning department on matters related to action against Unauthorised Constructions. If such cooperation is not provided then the state takes disciplinary action against the erring officials. 🔟Appeals must be disposed of within 90 days. 1️⃣1️⃣Govt. must come out with circulars with a warning to all concerned to scrupulously follow earlier directions as well as this order of the court. "STRENGTHENING THE IMPLEMENTATION OF THE REAL ESTATE (REGULATION AND DEVELOPMENT) ACT, 2016, ODISHA" After the review of the implementation of RERA in all states, Govt. of Odisha conducted a meeting on the 17th June 2025 and took some important decisions. ✅Co-ordination between departments. ✅ Execution of Orders/Recoveries. ✅ Enforcement by BDA/BMC team. ✅ Tahsildars to report "unauthorised Developments". ✅ Monthly review meetings. (A) Proposed regular coordination meetings: one of the biggest drawback till now was the reluctance of @OdishaRera to coordinate with other departments/ Authorities regarding implementation of the provisions of the RE(R&D) Act. Lack of coordination across departments was misused by the promoters to further their ill intended work. Home Buyers had difficult times convincing authorities of various departments related to RERA Provisions. It has been decided to, 1) Conduct MONTHLY coordination meeting between ORERA, Dept. of Revenue and Dept. of Housing 2) All Collectors and Tahsildars shall report any unauthorised plotted schemes or Real Estate constructions under their jurisdiction to the ORERA every MONTH. 3) ORERA shall conduct joint enforcement drive with the help of BDA/BMC (note: hope it will be extended to other areas of the state very soon). A MONTHLY enforcement calendar shall be prepared and monitored by ORERA (B) Use of Technology To ensure effective implementation of the RE(R&D) Act, help of technology in the following issues shall be utilised, 1) Integration of BHULEKH software with ORERA 2.0 within 60 days 2) A digital protocol to share information of plan approval in real time shall be developed within 60 days. (C) Execution of ORERA orders: The department of H&UD and R&DM shall coordinate to ensure execution under the OPDR Act regarding recoveries. (D) Implementation of the provisions of RERA shall be a permanent agenda point in collectors' review meetings. (E) Staffing: (1) The Dept. of GA & PG shall take immediate steps to appoint Jt. Secy. (Admin.) and Dy. Secy. (Enforcement) in ORERA. (2) ORERA shall select Retd. Govt. Thank you: @PMOIndia , @SecyChief and @OdishaRera BACKGROUND: For many months/years, home buyers were requesting for A review of Implementation of RE(R&D) in Odisha. The Real Estate Regulatory Authority (RERA) in the state has increasingly been perceived as an inefficient government entity, primarily serving as a rehabilitation platform for retired bureaucrats and employees. Several decisions made by the Odisha Real Estate Regulatory Authority (ORERA) appear to favour prominent builders. The earlier Chairperson has consistently demonstrated reluctance to adopt proactive measures. ORERA has publicly conveyed a sense of its own limitations, deliberately refraining from exercising the extensive powers granted under the provisions of the Act. The execution of ORERA's orders has been virtually non-existent, further undermining its effectiveness. Additionally, ORERA has failed to assume a leadership role in guiding and regulating the real estate sector within the state. The government authorities within the parent Department of Housing and Disaster Management have shown indifference toward the effective implementation of the Act in the state. Political leaders, reportedly connected to influential builders and land mafias, appear happy with a weakened and disorganized ORERA. 28thMay 2025: PRAGATI meeting The much needed “SANJIVANI” came from non-other than the Prime Minister when he decided to review the implementation of the RE(R&D) Act in the country. Sri Narendra Modi spoke about, · Timely project delivery · Efficiency and accountability · Quality and timeliness of grievance disposal · Mandatory Registration of all eligible Real Estate projects · Strict compliance with RERA provisions The Pragati meeting triggered the need of review of functioning of the state RERA in all states. After the meeting, an urgency was shown by the state administration towards the effectiveness of the RERAs. Odisha was no exception. 5th June: letter of the Chairperson, ORERA In the meantime, A new Chairperson had joined ORERA, who wrote a letter to the Chief Secretary Mr. Manoj Ahuja, emphasising various issues to improve the functioning of the statutory body. 17th June: Meeting chaired by the Chief Secretary After the Pragati review meeting and the letter from the ORERA Chairperson, a state specific review meeting was conducted under the chairmanship of the Chief Secretary to discuss the suggestions of the ORERA. The meeting was attended by Mr. Manoj Ahuja, Chief Secretary, Shri Asit Kumar Mohapatra, Chairperson, ORERA, Smt Usha Padhee, IAS, Principal Secretary, H & UD Dept., Smt. Madhusmita Sahoo, IAS, Additional Secretary, R & DM Dept. Shri Subrata Satapathy, IAS, IGR, Odisha besides other officials from the Dept. of H&UD, R&DM and ORERA. 1st July: Minutes of the meeting Decisions taken, 1. All plan approving Authorities will inform ORERA in real time regarding any plan approval. ସମସ୍ତ ଯୋଜନା ଅନୁମୋଦନ କର୍ତ୍ତୃପକ୍ଷORERAକୁ ଯୋଜନା ଅନୁମୋଦନ ସମ୍ପର୍କରେ ତୁରନ୍ତ ଏବଂ ରିଅଲ୍ ଟାଇମ୍‌ରେ ସୂଚନା ପ୍ରଦାନ କରିବେ। 2. SUJOG portal shall be integrated to ORERA 2.0 SUJOG ପୋର୍ଟାଲORERA 2.0 ସହିତ ସଂଯୋଜିତ ହେବ ଯାହା ଦ୍ୱାରା ଡାଟା ଦୋହରାଣି ରୋକାଯାଇ ଓORERA ତଥ୍ୟ ଯାଞ୍ଚ କରିପାରିବ। 3. For recovery under OPDR Act, from now on Dept. of H&UD will coordinate with Dept. of R&DM. OPDR ଆଇନ ଅଧୀନରେ ରିକଭରି ପାଇଁ ଗୃହ ଓ ନଗର ଉନ୍ନୟନ ବିଭାଗ(H&UD) ଏବେ ଠାରୁ ରାଜସ୍ୱ ଓ ଭୂମି ବ୍ୟବସ୍ଥା ବିଭାଗ(R&DM) ସହିତ ସମନ୍ୱୟ କରିବ। 4. ORERA will be able to take the help of the enforcement wing of BDA/BMC for implementation of its orders. ORERA ତାଙ୍କ ଆଦେଶ କାର୍ଯ୍ୟକାରୀ କରିବା ପାଇଁBDA/BMCର ପ୍ରବର୍ତ୍ତନ ଶାଖାର ସହାୟତା ନେଇପାରିବ। ଏହାସହ ମାସିକ ପ୍ରବର୍ତ୍ତନ କ୍ୟାଲେଣ୍ଡର ପ୍ରକାଶିତ କରାଯିବ। 5. From now on, a monthly coordination meeting between ORERA, Dept. of Revenue and Dept. of H&UD has been institutionalised. ଏବେ ଠାରୁORERA, ରାଜସ୍ୱ ବିଭାଗ ଏବଂ ଗୃହ ଓ ନଗର ଉନ୍ନୟନ ବିଭାଗ ମଧ୍ୟରେ ମାସିକ ସମନ୍ୱୟ ବୈଠକ ପ୍ରତିଷ୍ଠିତ ହେବ। 6. Collectors and Tahsildars will inform Illegal real estate developments every month to ORERA. ଜିଲ୍ଲାପାଳ ଓ ତହସିଲଦାର ପ୍ରତି ମାସ ଅବୈଧ ରିଅଲ୍ ଇଷ୍ଟେଟ୍ ବିକାଶ(ପ୍ଲଟିଂ ଏବଂ ଆପାର୍ଟମେଣ୍ଟ) ସମ୍ପର୍କରେORERAକୁ ସୂଚନା ପ୍ରଦାନ କରିବେ। 7. From now on, implementation of RERA provisions will become a permanent agenda point of Collector's review meetings. ଏବେ ଠାରୁRERA ନିୟମାବଳୀର କାର୍ଯ୍ୟକାରୀତା ଜିଲ୍ଲାପାଳଙ୍କ ସମୀକ୍ଷା ବୈଠକର ଏକ ସ୍ଥାୟୀ ଏଜେଣ୍ଡା ପଏଣ୍ଟ ହେବ। 8. Dept. of GA &PG shall immediately fill up jt. Secy. (Admin) and Dy. Secy. (Enforcement) in ORERA. ସାଧାରଣ ଓ ସାର୍ବଜନୀନ ପ୍ରଶାସନ ବିଭାଗ(GA & PG) ORERAରେ ଯୁଗ୍ମ ସଚିବ(ପ୍ରଶାସନ) ଏବଂ ଉପ-ସଚିବ(ପ୍ରବର୍ତ୍ତନ) ପଦବୀ ତୁରନ୍ତ ପୂରଣ କରିବ। 9. ORERA shall select through open advertisements all sanctioned posts with retd. Govt. Servant. ORERA ସମସ୍ତ ମଞ୍ଜୁରୀପ୍ରାପ୍ତ ପଦବୀ ପାଇଁ ଅବସରପ୍ରାପ୍ତ ସରକାରୀ କର୍ମଚାରୀଙ୍କୁ ଖୋଲା ବିଜ୍ଞାପନ ମାଧ୍ୟମରେ ନିର୍ବାଚନ କରିବ। 10. Regular review meeting from now on between Dept. of H&UD and ORERA. ଏବେ ଠାରୁ ଗୃହ ଓ ନଗର ଉନ୍ନୟନ ବିଭାଗ ଏବଂORERA ମଧ୍ୟରେ ନିୟମିତ ସମୀକ୍ଷା ବୈଠକ ଅନୁଷ୍ଠିତ ହେବ। Attachments: 1. Minutes of PRAGATI MEETING 2. After the meeting, an urgency was shown by the state administration towards the effectiveness of the RERAs. Odisha was no exception. 5th June: letter of the Chairperson, ORERA In the meantime, A new Chairperson had joined ORERA, who wrote a letter to the Chief Secretary Mr. Manoj Ahuja, emphasising various issues to improve the functioning of the statutory body. 17th June: Meeting chaired by the Chief Secretary After the Pragati review meeting and the letter from the ORERA Chairperson, a state specific review meeting was conducted under the chairmanship of the Chief Secretary to discuss the suggestions of the ORERA. The meeting was attended by Mr. Manoj Ahuja, Chief Secretary, Shri Asit Kumar Mohapatra, Chairperson, ORERA, Smt Usha Padhee, IAS, Principal Secretary, H & UD Dept., Smt. Madhusmita Sahoo, IAS, Additional Secretary, R & DM Dept. Shri Subrata Satapathy, IAS, IGR, Odisha besides other officials from the Dept. of H&UD, R&DM and ORERA. 1st July: Minutes of the meeting Decisions taken, 1. All plan approving Authorities will inform ORERA in real time regarding any plan approval. ସମସ୍ତ ଯୋଜନା ଅନୁମୋଦନ କର୍ତ୍ତୃପକ୍ଷORERAକୁ ଯୋଜନା ଅନୁମୋଦନ ସମ୍ପର୍କରେ ତୁରନ୍ତ ଏବଂ ରିଅଲ୍ ଟାଇମ୍‌ରେ ସୂଚନା ପ୍ରଦାନ କରିବେ। 2. SUJOG portal shall be integrated to ORERA 2.0 SUJOG ପୋର୍ଟାଲORERA 2.0 ସହିତ ସଂଯୋଜିତ ହେବ ଯାହା ଦ୍ୱାରା ଡାଟା ଦୋହରାଣି ରୋକାଯାଇ ଓORERA ତଥ୍ୟ ଯାଞ୍ଚ କରିପାରିବ। 3. For recovery under OPDR Act, from now on Dept. of H&UD will coordinate with Dept. of R&DM. OPDR ଆଇନ ଅଧୀନରେ ରିକଭରି ପାଇଁ ଗୃହ ଓ ନଗର ଉନ୍ନୟନ ବିଭାଗ(H&UD) ଏବେ ଠାରୁ ରାଜସ୍ୱ ଓ ଭୂମି ବ୍ୟବସ୍ଥା ବିଭାଗ(R&DM) ସହିତ ସମନ୍ୱୟ କରିବ। 4. ORERA will be able to take the help of the enforcement wing of BDA/BMC for implementation of its orders. ORERA ତାଙ୍କ ଆଦେଶ କାର୍ଯ୍ୟକାରୀ କରିବା ପାଇଁBDA/BMCର ପ୍ରବର୍ତ୍ତନ ଶାଖାର ସହାୟତା ନେଇପାରିବ। ଏହାସହ ମାସିକ ପ୍ରବର୍ତ୍ତନ କ୍ୟାଲେଣ୍ଡର ପ୍ରକାଶିତ କରାଯିବ। 5. From now on, a monthly coordination meeting between ORERA, Dept. of Revenue and Dept. of H&UD has been institutionalised. ଏବେ ଠାରୁORERA, ରାଜସ୍ୱ ବିଭାଗ ଏବଂ ଗୃହ ଓ ନଗର ଉନ୍ନୟନ ବିଭାଗ ମଧ୍ୟରେ ମାସିକ ସମନ୍ୱୟ ବୈଠକ ପ୍ରତିଷ୍ଠିତ ହେବ। 6. Collectors and Tahsildars will inform Illegal real estate developments every month to ORERA. ଜିଲ୍ଲାପାଳ ଓ ତହସିଲଦାର ପ୍ରତି ମାସ ଅବୈଧ ରିଅଲ୍ ଇଷ୍ଟେଟ୍ ବିକାଶ(ପ୍ଲଟିଂ ଏବଂ ଆପାର୍ଟମେଣ୍ଟ) ସମ୍ପର୍କରେORERAକୁ ସୂଚନା ପ୍ରଦାନ କରିବେ। 7. From now on, implementation of RERA provisions will become a permanent agenda point of Collector's review meetings. ଏବେ ଠାରୁRERA ନିୟମାବଳୀର କାର୍ଯ୍ୟକାରୀତା ଜିଲ୍ଲାପାଳଙ୍କ ସମୀକ୍ଷା ବୈଠକର ଏକ ସ୍ଥାୟୀ ଏଜେଣ୍ଡା ପଏଣ୍ଟ ହେବ। 8. Dept. of GA &PG shall immediately fill up jt. Secy. (Admin) and Dy. Secy. (Enforcement) in ORERA. ସାଧାରଣ ଓ ସାର୍ବଜନୀନ ପ୍ରଶାସନ ବିଭାଗ(GA & PG) ORERAରେ ଯୁଗ୍ମ ସଚିବ(ପ୍ରଶାସନ) ଏବଂ ଉପ-ସଚିବ(ପ୍ରବର୍ତ୍ତନ) ପଦବୀ ତୁରନ୍ତ ପୂରଣ କରିବ। 9. ORERA shall select through open advertisements all sanctioned posts with retd. Govt. Servant. ORERA ସମସ୍ତ ମଞ୍ଜୁରୀପ୍ରାପ୍ତ ପଦବୀ ପାଇଁ ଅବସରପ୍ରାପ୍ତ ସରକାରୀ କର୍ମଚାରୀଙ୍କୁ ଖୋଲା ବିଜ୍ଞାପନ ମାଧ୍ୟମରେ ନିର୍ବାଚନ କରିବ। 10. Regular review meeting from now on between Dept. of H&UD and ORERA. ଏବେ ଠାରୁ ଗୃହ ଓ ନଗର ଉନ୍ନୟନ ବିଭାଗ ଏବଂORERA ମଧ୍ୟରେ ନିୟମିତ ସମୀକ୍ଷା ବୈଠକ ଅନୁଷ୍ଠିତ ହେବ। Attachments: 1. Minutes of PRAGATI MEETING 2. O R E R A @OdishaRera APPOINTMENT OF THE SECRETARY ସରକାରୀ କର୍ମଚାରୀଙ୍କ ନିୟମିତ ବ୍ୟବଧାନରେ ବଦଳି ପାଇଁ ନିର୍ଦ୍ଦେଶ । ଗୋଟିଏ ସ୍ଥାନରେ ୩ ବର୍ଷରୁ ଅଧିକ ସମୟ ରହିପାରିବେନି ସରକାରୀ କର୍ମଚାରୀ : Government of Odisha Then who and why in the @CMO_Odisha made the exception in the case of appointment of the Secretary, ORERA? Someone came up with a brilliant idea of promoting the Joint Secretary (Admin.) who had already worked at ORERA for more than 4 years, to the position of Secretary in the same office. @nbdhal Is this inline with the Govt.'s 3 years transfer policy? Specially when, 1. the ORERA Authority had reported insubordination against the same officer, 2. the Pr. Secy, in letter no. 89, dt.22.01.2025 had recommended the transfer of the officer, 3. though the allegation of Corruption at ORERA was serious, the ex-Chairperson did not agree to handover the inquiry to the @OdishaVigilance . Where as the Govt. should have fixed accountability and transferred the Admin. team immediately. For the sake of winning the trust of the Home Buyers, it is important that the Government takes steps to keep the office of ORERA above corruption. Otherwise, the very purpose for the RERA Act will be defeated. Requesting the @CMO_Odisha @SecyChief and @HUDDeptOdisha to, 1) consult the Authority for a Vigilance inquiry to the allegation of Corruption by present and past staff, 2) make it compulsory to declare assets by all staff of ORERA, 3) ensure immediate transfer of Govt. employees who have worked in ORERA for more than 3 years, 4) send a clear message to the ORERA as well as the Promoters & Home Buyers, regarding the power and jurisdiction of the Authority as mandated under the RERA Act. @dr_kcmahapatra @ushapadhee1996

S A V E O R E R A @CMO_Odisha How can the Secretary force stop the functioning of the Authority? If true, this is an unprecedented situation at @OdishaRera Section 25, RERA along with Rule 20 of Odisha RERA Rules gives unquestionable powers to the Chairperson. Any insubordination should not be encouraged by the Authority or the Government. (it seems from the news article, the file recommending action against the Secretary, ORERA is pending with the @CMO_Odisha) By not processing the "Forensic Audit" files for weeks, only the concerned builders are getting benefitted. If the news report is true, then there seems to be an attempt to suppress the financial irregularities committed by a few builders which have affected thousands of Home Buyers. A few months back, Corruption allegations led to the disengagement of a DEO and then a series of transfers and disengagements were effected in ORERA. A @OdishaVigilance order was discouraged by the then Chairperson. Was there a fear of large scale exposure? There is a visible sense of uneasiness at the office of ORERA since then. (the current authority should recommend a vigilance inquiry into the actions by current and previous staff to ensure transparency) Further, The engagement of any govt. officer for more than 5 years in the same office raises questions. Recommendation from the H&UD department was ignored then. @nbdhal At a time when (i)scrutiny before project registration needs to be strengthened, (ii)the enforcement wing at ORERA needs to be more efficient, (iii)a lot has to be done for execution of orders.... such a situation where the Secretary's actions affects the smooth functioning of the office of ORERA is unwarranted. Weakening ORERA: The Government has to take some blame as well. Consider this, 1. @sureshkpujari openly questioned the need for the RERA Act in a state like Odisha, 2. @HUDDeptOdisha allowed the previous Chairperson to continue for 15 months even after joining another position in Delhi, 3. @CMO_Odisha delayed the appointment of the Chairperson (in-charge) keeping the ORERA headless for a month. 4. ORERA's communications requesting communications to plan approving authorities on various issues is being ignored for months @dr_kcmahapatra 5. Proposal by ORERA on "reconciliation forum" is pending @ushapadhee1996 6. Now the recommendation of the Chairperson to the @SecyChief on the issue of insubordination by the Secretary has not been acted upon.
