When two sovereign states merge to form a single new entity, the resulting state cannot obtain formal recognition or United Nations membership without submitting the legal treaty of union to the UN.
Under Article 102 of the UN Charter, every international agreement must be registered with the UN Secretariat and published before it can be invoked before any organ of the United Nations.
Somalia has never deposited or registered any treaty of union between Somaliland and the former Italian-administered Somalia with the United Nations.
Nevertheless, it continues to claim the territory of Somaliland, which gained independence from Britain on 26 June 1960. Somalia attained independence from the Italian UN trusteeship on 1 July 1960.
No formal treaty of union between the 2 states was ever submitted. According to Article 102 of the UN Charter, every treaty and international agreement entered into by any Member of the United Nations must be registered with the Secretariat and published by it as soon as possible.
Key Requirements for Membership
➡️Submission of Treaty: Documentation of the union must be presented to prove the legal dissolution of the former states and the creation of the new one.
➡️Registration: Under Article 102, no party to an unregistered treaty may invoke that treaty before any organ of the United Nations.
➡️Validation: The UN Secretariat must verify and publish the agreement to ensure transparency and international recognition.
